These terms are an agreement between you and {{OPERATOR}}, {{ADDRESS}} (“we”), the maker of the Palmday app. By using Palmday you accept them. If you downloaded Palmday from the App Store, Apple’s Licensed Application End User License Agreement also applies, and these terms add to it.
What Palmday is
Palmday is a wellness and habit app that helps you track quitting or cutting down on nicotine, with an island that grows as you go. It is not a medical device, a medical treatment or medical advice, and it does not promise any result. Health information in the app is general information from public sources, which the app names. For advice about your health or about quitting, talk to a doctor or another health professional. Free support from the World Health Organization is linked in Settings.
Who can use Palmday
You must be at least {{MIN_AGE}} and old enough to buy nicotine products where you live.
Palmday Premium (subscription)
- Palmday Premium is offered as a yearly or a monthly subscription. The price and length are shown in the App Store or Google Play before you buy, in your currency.
- The yearly subscription may start with a free trial for new subscribers. If you do not cancel before the trial ends, the subscription starts and you are charged.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. The renewal is charged to your App Store or Google Play account.
- You can manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops future renewals; you keep access until the end of the period you paid for.
- Refunds are handled by Apple or Google under their own policies.
Island styles
Island styles are one-time purchases. They are separate from the subscription: they are not included in it, and buying one does not start a subscription. You can restore them on a new phone with “Restore purchases”, using the same App Store or Google Play account.
Your data
Your plan and logs are stored on your phone (see the privacy policy). Keeping a backup is your choice: use your phone’s backup or the CSV export in Settings. If your phone is lost or reset without a backup, we cannot recover your data.
Using Palmday
Palmday is licensed to you for personal, non-commercial use. Please don’t copy, resell, reverse-engineer or misuse the app or its content, except where the law allows it. The app, its island art, sounds and words belong to us or our licensors.
Changes and availability
We may update Palmday, add or change features, or stop offering it. If we stop offering a paid feature you are subscribed to, we will tell you, and you can cancel through your store account.
Liability
We make Palmday with care, but it is provided “as is”. To the extent the law allows, we are not responsible for indirect losses or for decisions you make based on the app. Nothing in these terms limits rights you have as a consumer under the law of your country.
Changes to these terms
If we change these terms, we will update the date at the top and, for important changes, tell you in the app. If you keep using Palmday after a change, the new terms apply.
Law
These terms are governed by the law of {{GOVERNING_LAW}}. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.
